Every single one of these phrases has been flagged by HUD or courts as potentially discriminatory. "Perfect for young families" can be read as preferring families with children over single buyers or elderly buyers (familial status). "Walking distance to churches" can be read as preferring Christian buyers (religion). "Safe, quiet neighborhood" can be read as a coded reference to racial or socioeconomic composition, depending on context.
Generic AI tools produce these phrases constantly. They don't know better. Nothing in their training tells them "this phrase is legally dangerous." They just pattern-match whatever reads naturally in American real estate copy.

The Department of Justice has already brought Fair Housing enforcement against an AI system in the housing advertising space. The five most common AI-generated Fair Housing violations

Religious or ethnic geographic references: "Close to Temple Israel." "Minutes from Saint Anthony's." "Heart of Little Italy." "In the Jewish community of [X]." Descriptions that anchor a property to a religious institution or ethnic enclave signal a preferred buyer demographic, even if the intent is just nearby landmarks. HUD has flagged this specifically.
Disability-exclusion language: "No wheelchair access needed!" "Second-story master suite, great for fit buyers." "Lots of stairs, good for active families." Mentioning physical features in ways that exclude disabled buyers is explicitly prohibited, even when the intent is just to describe the property accurately.
Coded neighborhood descriptions: "Safe neighborhood." "Quiet street." "Good schools." "Crime-free area." "Established community." These phrases are specifically flagged by HUD because they've historically been used as proxies for racial or socioeconomic discrimination. Even when an agent is describing objective features, these phrases carry legal risk.
Gendered assumptions: "Man cave in the basement." "Wife's dream kitchen." "Husband's workshop." "Ladies' sitting room." Gendered role descriptions fall under sex and gender identity protection. "Master bedroom" is also increasingly flagged, though its status is still debated.
Every one of these patterns appears routinely in AI-generated listing descriptions. I've seen all five in outputs from ChatGPT in the last month.
The "I didn't know" problem
Most agents who use ChatGPT for listings aren't doing anything malicious. They're just trying to save time on a task they find tedious. When the output includes "perfect for a young family," they don't read it as a legal risk. They read it as friendly copy.
